The Action Alliance (AA) has announced the withdrawal of its petition against the Independent National Electoral Commission (INEC) and President-elect Asiwaju Bola Tinubu. The party, represented by its legal team led by Mr. Oba Maduabuchi, SAN, requested to discontinue further proceedings in the case during the Presidential Election Petition Court (PEPC) pre-hearing session on Monday.
Oba, SAN, informed the court that the petitioners had filed a withdrawal notice on May 3. With no objections from any of the respondents, the Justice Haruna Tsammani-led five-member panel dismissed the petition.
In the petition filed on March 16, the AA argued that its candidate, Solomon Okanigbuan, had been validly nominated to contest the presidential election but was unlawfully excluded by INEC. The party claimed that the presidential election was “invalid for non-compliance with the provisions of the Electoral Act 2022, as amended.”
The petitioners argued that Tinubu’s election contravened the Electoral Act, the 1999 Constitution, and INEC guidelines for the 2023 general elections. They also asserted that Major Hamza Al-Mustapha, the fourth respondent in the case, was not an AA member, was not sponsored by the party, and did not participate in its presidential primary election.
