{"id":264256,"date":"2020-09-30T07:52:44","date_gmt":"2020-09-30T06:52:44","guid":{"rendered":"https:\/\/arewa.ng\/?p=264256"},"modified":"2020-09-30T07:58:32","modified_gmt":"2020-09-30T06:58:32","slug":"court-dismisses-el-zakzakys-no-case-submission","status":"publish","type":"post","link":"https:\/\/arewa.ng\/?p=264256","title":{"rendered":"Court Dismisses El-Zakzaky\u2019s No-case Submission"},"content":{"rendered":"<div>A Kaduna State High Court has thrown out a no-case submission filed by Ibrahim El-Zakzaky, leader of the Islamic Movement in Nigeria, and his wife, Zeenat.<br \/>\n<span class=\"container container-pod container-pod-short\"><span class=\"adunit-parent hide block-module block-module-ad block-module-ad-300x250\"><span class=\"block-module-image-wrapper\"><\/span><\/span><\/span><\/p>\n<p>El-Zakzaky whose health had been rapidly deteriorating since his detention in December 2015 after he was arrested by the Nigeria Army, is seeking to quash the government\u2019s charges against him.<br \/>\n<span class=\"ds-1col file file-image file-image-jpeg view-mode-embedded centered clearfix block-story-object block-story-object-resource block-story-object-resource-image\"><br \/>\n<span class=\"block-story-object-asset\"><img decoding=\"async\" class=\"media-element file-embedded\" typeof=\"foaf:Image\" src=\"https:\/\/arewa.ng\/storage\/2020\/09\/Court-Dismisses-El-Zakzakys-No-case-Submission.jpg\" alt=\"\"><\/span><br \/>\n<\/span><\/p>\n<p>The IMN leader and his wife are being prosecuted by the Kaduna State Government on an eight-count charge bordering on alleged culpable homicide, unlawful assembly and disruption of the public peace.<\/p>\n<p>Marshall Abubakar holding brief for foremost rights lawyer, Femi Falana, had on August 7 asked the court to dismiss the charges against El-Zakzaky and Zeenat.<\/p>\n<p>He said the government had failed to \u201cdisclose an offence known to law contrary to Section 36 (8) and (12) of the 1999 constitution as amended\u201d against his clients.<br \/>\n<span class=\"ds-1col block-story-object block-story-object-link block-story-object-link-story\" about=\"http:\/\/saharareporters.com\/2020\/07\/07\/shiites-raise-alarm-over-el-zakzakys-health-amid-fears-stroke-blindness\" typeof=\"sioc:Item foaf:Document\"><br \/>\n<span class=\"block-story-object-content\"><br \/>\n<span class=\"block-story-object-content-body\"><br \/>\n<span class=\"node node-story node-promoted node-sticky taxonomy-human-rights view-mode-embedded_link block-module block-module-small block-module-story\"><br \/>\n<span class=\"block-module-image block-module-image-scale-to-fit\"><span class=\"block-module-image-wrapper\"><span class=\"image-background-wrapper\"><img decoding=\"async\" class=\"\" typeof=\"foaf:Image\" src=\"https:\/\/arewa.ng\/storage\/2020\/09\/1601426335_953_Court-Dismisses-El-Zakzakys-No-case-Submission.jpg\" width=\"100\" height=\"100\" alt=\"\"><\/span><\/p>\n<p><\/span><\/p>\n<p><\/span><br \/>\n<\/span><br \/>\n<\/span><br \/>\n<\/span><br \/>\n<\/span><\/p>\n<p>Delivering a ruling on the submission on Tuesday, Justice Gideon Kudara held that the application was premature and contravenes the Kaduna State administration of criminal justice.<\/p>\n<p>He said a no-case application should be submitted after the accessed parties had taken their pleas and after the hearing of the matter had ended.<\/p>\n<p>El-Zakzaky and his wife pleaded not guilty when the eight-count charge was read to them.<\/p>\n<p>Justice Kudara adjoured the matter until November 18 and 19, 2020 for continuation of trial and to enable the prosecution counsel to present witnesses before the court.<\/p><\/div>\n<p>(SaharaReporters)<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Kaduna State High Court has thrown out a no-case submission filed by Ibrahim El-Zakzaky, leader of the Islamic Movement in Nigeria, and his wife, Zeenat.
