{"id":172534,"date":"2019-12-03T09:17:31","date_gmt":"2019-12-03T07:17:31","guid":{"rendered":"https:\/\/arewa.ng\/?p=172534"},"modified":"2019-12-03T08:24:19","modified_gmt":"2019-12-03T07:24:19","slug":"lagos-court-orders-seizure-of-emirates-aircraft-over-n8m-debt","status":"publish","type":"post","link":"https:\/\/arewa.ng\/?p=172534","title":{"rendered":"Lagos Court Orders Seizure Of Emirates Aircraft Over N8m Debt"},"content":{"rendered":"<div><span class=\"ds-1col file file-image file-image-jpeg view-mode-embedded centered clearfix block-story-object block-story-object-resource block-story-object-resource-image\"><br \/>\n<span class=\"block-story-object-asset\"><img decoding=\"async\" class=\"media-element file-embedded\" typeof=\"foaf:Image\" src=\"https:\/\/arewa.ng\/storage\/2019\/12\/Lagos-Court-Orders-Seizure-Of-Emirates-Aircraft-Over-N8m-Debt.jpg\" alt=\"\"><\/span><br \/>\n<\/span><\/p>\n<p><span class=\"container container-pod container-pod-short\"><span class=\"adunit-parent hide block-module block-module-ad block-module-ad-300x250\"><span class=\"block-module-image-wrapper\"><\/span><\/span><\/span><\/p>\n<p>A Federal High Court sitting in Lagos on Monday ordered the seizure of an aircraft belonging to Emirates Airline over an N8.1m judgment debt, according to BusinessDay.<\/p>\n<p>The order followed a motion filed by Charles Mekwunye seeking the enforcement of a Supreme Court judgment in a suit between Promise Mekwunye and the airline.<\/p>\n<p>Granting the reliefs sought by Mekwunye, Justice Mohammed Liman held that, \u201cIt is accordingly ordered that an attachment is hereby issued on the judgment debtor\u2019s aircraft registered as \u2018A6 Aircraft Type 77W EK: 783\/784\u2019, or any other aircraft belonging to the judgment debtor, which flies into Nigeria Territory, to be arrested and detained until the judgment debt is fully paid.<\/p>\n<p>\u201cIf there is default after 30 days, the aircraft shall be auctioned to satisfy the judgment debt.\u201d<\/p>\n<p>The judge also ordered that Emirates Airline to bear the cost of maintenance and custody of the detained aircraft<\/p>\n<p>Mekwunye, who was then a student of North Texas University, Denton, Texas, United States, had in 2008 dragged the airline to court for refusal of her two-way flight ticket from Dallas to Nigeria and back for no reason and for also refusing to fully refund the cost of the American Airline ticket she bought for her return trip to Nigeria.<\/p>\n<p>She claimed that the airline offered no reason for its action, leaving her stranded for days at the airport until she was able to secure a more expensive flight ticket on a longer route to Lagos.<\/p>\n<p>In a judgment delivered on November 15, 2010, the Federal High Court in Lagos held that the refusal of Emirates Airline to carry Mekwunye amounted to a breach of contract of carriage.<\/p>\n<p>Consequently, the court ordered a full refund of the ticket without any deduction or charge and further granted N2.5m in general damages and N250,000 in legal costs against the airline.<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>A Federal High Court sitting in Lagos on Monday ordered the seizure of an aircraft belonging to Emirates Airline over an N8.1m judgment debt, according to BusinessDay.
