{"id":168546,"date":"2019-11-17T14:50:07","date_gmt":"2019-11-17T13:50:07","guid":{"rendered":"https:\/\/arewa.ng\/?p=168546"},"modified":"2019-11-17T14:50:21","modified_gmt":"2019-11-17T13:50:21","slug":"court-sacks-imo-lawmakers-orders-election-rerun-in-90-days","status":"publish","type":"post","link":"https:\/\/arewa.ng\/?p=168546","title":{"rendered":"Court Sacks Imo Lawmakers, Orders Election Rerun In 90 Days"},"content":{"rendered":"<div><span class=\"ds-1col file file-image file-image-jpeg view-mode-embedded centered clearfix block-story-object block-story-object-resource block-story-object-resource-image\"><br \/>\n<span class=\"block-story-object-asset\"><img decoding=\"async\" class=\"media-element file-embedded\" typeof=\"foaf:Image\" src=\"http:\/\/arewa.ng\/wp-content\/uploads\/2019\/11\/Lack-Of-Space-Stalls-Arraignment-Of-57-Alleged-Gays-In-Lagos.jpg\" alt=\"\"><\/span><br \/>\n<\/span><\/p>\n<p><span class=\"container container-pod container-pod-short\"><span class=\"adunit-parent hide block-module block-module-ad block-module-ad-300x250\"><span class=\"block-module-image-wrapper\"><\/span><\/span><\/span><\/p>\n<p>An Appeal Court sitting in Owerri on Saturday sacked Obinna<br \/>\nOnwubuariri, the member representing Isiala Mbano\/Onuimo\/Okigwe<br \/>\nfederal constituency of Imo in the House of representatives.<\/p>\n<p>The court also nullified the election of Uju Onwudiwe of the Action<br \/>\nAlliance (AA) representing Njaba state constituency and ordered fresh<br \/>\nelections in 12 polling units within 90 days.<\/p>\n<p>The PDP candidate, Charles Abia had challenged the victory of Onwudiwe<br \/>\nin the appeal court.<\/p>\n<p>The Chairman of the Panel, Justice R.N Pemu, who read the judgment,<br \/>\nsaid that the election that brought Onwubuariri of the Peoples<br \/>\nDemocratic Party (PDP) to power on February 23 was not in tandem with<br \/>\nthe electoral act of 2010, as amended.<\/p>\n<p>The appellate court said the lower court was right to have ordered a<br \/>\nfresh election in the federal constituency.<\/p>\n<p>Pemu said the petitioner, Miriam Onuoha of the All Progressives<br \/>\nCongress (APC), was able to prove her allegations of over-voting,<br \/>\nmutilation of figures and violence which marred the election.<\/p>\n<p>The court, therefore, ordered the Independent National Electoral<br \/>\nCommission (INEC) to withdraw the certificate of return it had earlier<br \/>\nissued Onwubuariri and conduct a fresh election in the entire federal<br \/>\nconstituency within 90 days.<\/p>\n<p>The tribunal had sacked Onwubuariri, but the lawmaker dissatisfied<br \/>\nwith the judgment appealed the judgment.<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>An Appeal Court sitting in Owerri on Saturday sacked Obinna Onwubuariri, the member representing Isiala Mbano\/Onuimo\/Okigwe federal constituency of Imo in the House of representatives.
